Terms of Service - PDF NEST

1. Acceptance of Terms

By installing, accessing, or using PDF NEST, you agree to these Terms of Service. If you do not agree, do not use the Extension.

2. Description of Service

PDF NEST is a Google Chrome extension that allows you to:

Capture screens of browser tabs or specific areas
Remove ads from the captured content (optional)
Generate and download PDF files

Local Processing: All processing occurs in your browser. We do not store, upload, or access the content you capture.

3. Eligibility

You must have:

At least 18 years of age (or the age of majority in your jurisdiction)
A valid Google account
Permission to use browser extensions on your device

If you are a minor, a legal guardian must accept these terms on your behalf.

4. Plans and Prices

4.1 Free Plan

Limit: 5 TAB Captures and 5 Smart Selections per day (resets daily)
Cost: Free
Renewal: Automatic daily reset

4.2 PRO Plan

Limit: Unlimited PDFs
Cost: As displayed in the application
Renewal: Automatic monthly (can be canceled at any time)
Priority processing: Access to premium features

4.3 Price Changes

We will notify you of price increases 30 days in advance. You can cancel before the new price is charged.

5. Payment

Processor: Stripe (third-party payment company)
Your responsibility: Provide accurate and complete payment information
Authorization: By subscribing to PRO, you authorize monthly automatic charges
Refunds: We do not offer refunds for months already paid (you can cancel at any time to avoid future charges)
Cancellation: Can be done at any time in the "Subscription" section of your account

6. Intellectual Property Rights

6.1 PDF NEST Ownership

The code, design, brand, features, and functionality of PDF NEST are the exclusive property of PDF NEST and protected by international copyright laws.

You MAY NOT:

Copy, modify, or create derivative versions
Decompile, reverse engineer, or attempt to discover the source code
Sell, rent, lease, or sublicense the Extension
Remove or alter any brands, copyright notices, or intellectual property

6.2 Your Ownership

The PDFs you generate are yours. You are the exclusive owner of all captured content converted into PDF. We make no claim over the PDFs you create.

7. Usage Restrictions

You agree NOT to use PDF NEST to:

Violate applicable laws or regulations
Capture, store, or share licensed content (movies, music, protected ebooks)
Circumvent copyright protections (DRM, copy protections)
Violate third-party privacy (capture personal data without consent)
Fraud, phishing, malware, or illegal activities
Overload servers or perform denial of service (DoS) attacks
Reverse engineer, hack, or gain unauthorized access
Spam, harassment, or abusive behavior

Consequence: Violations may result in:

Suspension or cancellation of your account
Loss of credits and subscription (without refund)
Reporting to authorities (if it involves a crime)

8. Warranties and Disclaimers

8.1 "As Provided"

PDF NEST is provided "AS-IS" and "AS-AVAILABLE", without warranties of any kind, express or implied.

We DO NOT guarantee:

Error-free or uninterrupted operation
Compatibility with all websites
Perfect quality of generated PDFs
Absence of viruses or malware

8.2 Compliance and Legality

You are responsible for ensuring your use of PDF NEST complies with applicable laws and regulations, including:

Copyright and intellectual property laws
Data protection and privacy laws
Terms of service of the websites you capture
Laws of your jurisdiction

We are not responsible if you use the Extension for illegal purposes.

9. Limitation of Liability

IN NO EVENT SHALL WE BE LIABLE FOR:

Loss of data or PDFs
Direct, indirect, special, or consequential damages
Lost profits or loss of revenue
Any damage arising from the use or inability to use the Extension

MAXIMUM LIABILITY: Our total liability to you does not exceed the amount you paid in the last 12 months (or $0 if you paid nothing).

10. Termination

We may terminate or suspend your account immediately and without prior notice if you:

Violate these Terms of Service
Violate applicable laws
Engage in any fraudulent or harmful activity

You can stop using PDF NEST at any time by uninstalling the Extension from your browser.

11. Dispute and Arbitration

11.1 Amicable Resolution

Before any legal action, try to resolve the dispute with us through support. We will respond within 15 business days.

11.2 Binding Arbitration

Any dispute that is not resolved amicably will be resolved by binding arbitration, not by a court.

Exception: You may take small claims to small claims court if permitted by law.

12. Governing Law

These Terms of Service are governed by applicable international laws, particularly GDPR (EU) and LGPD (Brazil), where relevant.

13. Changes to Terms

We may update these Terms occasionally. Your continued use of PDF NEST after the changes means acceptance of the new Terms. If you do not agree with the changes, you should discontinue the use of the Extension.

14. General Provisions

14.1 Entirety

These Terms constitute the entire agreement between you and PDF NEST regarding the service.

14.2 Severability

If any provision is invalid, the others will remain in effect.

14.3 Waiver

Our failure to enforce any right does not constitute a waiver of that right.

14.4 Assignment

You may not assign your rights under these Terms without consent. We may assign our rights at any time.
